Terms & Conditions

Who, what, where 

 

  • ‘Thrive Legal’ is a trading name of Being Human Legal Consulting Limited ‘Being Human’, the company party to this agreement. 

  

  • The ‘User’ is the individual browsing or using the Site party to this agreement. 

  

  • Being Human grants you a non-exclusive and revocable license (“Terms & Conditions”) to use and access the website www.thrive-legal.co.uk (“Site”). In these Terms & Conditions, “us”, “we” and “our” refer to Being Human and references to “you” and “your” is to you, the User, both as defined above. 

  

  • The ‘Community’ is the Thrive Legal community, as detailed on the Site from time to time. 

 

  • An ‘Event’ is any event organised by, run by, supported by, run in conjunction with Being Human or publicly branded as a Thrive Legal, How to Thrive or Being Human event or promoted on the Site. 
     

  • ‘Services’ are access to any content, action, link, hyperlink, event tickets, access, photos and other services offered on the site. 

 

Community 

 

By applying to join the Community, you consent to the following conditions:

Eligibility 

​

  • The Community is free to join for in-house lawyers and legal professionals. If you apply to join the Community but do not fulfil these criteria we will contact you to discuss options for you to join. 

 

Membership 

​

  • Being Human has the right to cancel membership of anyone within the Community without warning or explanation. 

 

 

Content

  • Community content is subject to change, without notice 

 

Events 

 

By signing up or buying a ticket to an Event you consent to the following conditions:

Tickets and entry 

​

  • COVID-19: In the event that an Event is cancelled due to Government COVID-19 restrictions or guidance, Being Human will transfer your ticket to an alternative equivalent Event or provide you with an option for a refund of your ticket. If a refund is paid under this clause, you agree that Being Human will only pay the amount paid minus booking fee(s), processing fee(s), card fee(s) and, if applicable, invoice fee(s) incurred by Being Human. In the event of cancellation, Being Human will not pay for travelling or associated expenses or any loss other than the ticket purchase price. If the cancellation is due to any other Force Majeure the Force Majeure clause below will take effect. 

 

  • Once purchased, tickets to an Event are not refundable however, you can transfer them to another person. 

 

  • Being Human has the right to cancel the ticket or refuse entry to anyone at any Event without warning or explanation and refund their ticket. Common reasons for this may be failure to meet the criteria for admission or complaints. 

 

  • To enter an Event, every person will need a valid ticket. 

 

  • For security purposes, Being Human has the right to search all bags at the entrance to any Event. 

 

  • Being Human has the right to change the date of an Event and will notify attendees as soon as reasonably practicable. If you need to have your ticket refunded because of the date change, please email info@being-human.co.uk 

 

  • Being Human will not accept liability for any other claim beyond the ticket price paid. 

 

  • Being Human is not responsible for attendee costs including accommodation, travel or visas. 

 

  • Tickets must be purchased online for the event. In the very rare instance where you have to pay by invoice there is a £50 +VAT fee. If we are required to additionally set up as a supplier on your system there is an additional £50 +VAT fee. Tickets paid for by invoice are not issued until the funds clear in our account. If the event is sold out before the funds clear you will be refunded for the ticket price only. 

 

At The Event 

​

  • Being Human will take live video and photos at an Event, if you feature in these, you consent to Being Human using these for any purpose. You can request a picture is removed as far as reasonably practicable by notifying Being Human by email: info@being-human.co.uk 

 

  • Being Human takes no responsibility for allergens contained in food and drink provided at any Event. If an attendee is sensitive to certain allergens, it is the attendees’ responsibility to make sure they notify Being Human within 10 working days before an Event so that Being Human can use their reasonable endeavors to provide allergen information to the attendee. 

 

  • Event schedule, topics and speakers are subject to change, without notice. 

 

Your data 

 

Please refer to our Privacy policy available here.

  • By signing up to an Event we will email you important information about the Event you are attending.  

 

  • The name of the company you work for and your job title will be shared with some sponsors of an Event. If you wish to opt out of this please email info@being-human.co.uk 

 

What do you agree to when using this site 

 

By using the Site you agree to be bound by these Terms & Conditions. If you do not agree with these Terms & Conditions you must immediately stop using the Site.

  • We will not be liable for any loss, injury, or damage from the display or use of the information on the Site; 

 

  • The User accepts all data and information provided on the Site is for informational purposes only; 

 

  • We may change, update or otherwise amend the Site at our absolute discretion at any time and without notice; 

 

  • You acknowledge & accept the Privacy Policy and any other terms or conditions found on the site. 

 

Who can use the site & access the services 

 

You are granted a non-exclusive, limited and revocable licence to access the Site on the condition that:

  • You only use the Site for lawful purposes; 

 

  • You do not engage in any defamatory, improper, indecent or offensive behaviour; 

 

  • You are not breaking any local, national or European law in your relevant jurisdiction by accessing this Site; 

 

  • You will treat the Site and its Users with respect and will not partake in any conduct that could be considered bullying, harassment, degradation, insulting or otherwise demeaning to the human standard of any other person (as determined by us); and 

 

  • You do not breach any of these Terms and Conditions. 

 
Site availability 

 

  • By using this Site you acknowledge that we are not required to keep the Site available for your use and we make no warranties as to its availability. 

 

  • We accept no responsibility for the unavailability of this Site, or any offers of Services found on the Site, and you agree that we are not liable for any loss or damage that you or any other person may incur by not being able to access the Site. 

 

  • We make no guarantees, implied or express, as to the ongoing availability of the Site or Services. 

 

Intellectual property 

 

All content on the Site and the Services are the copyright and property of Being Human. Without the express written permission of Being Human, you shall not:

  • Replicate all or part of the Site or Services in anyway; or 

 

  • Incorporate all or part of the Site or Services in any other webpage, site, application or other digital or non-digital format. 

 

  • Being Human has moral & unregistered rights in its trademarks and you shall not copy, alter, use or otherwise deal in the marks without the prior written consent of Being Human. 

 

  • You agree that by using the Site you will not copy the Site or Services for your own commercial purposes. You agree and warrant that you will not solicit the Users and Members of the Site to join another competing site or in any way to stop using the Site in preference of using another site offering comparable services. You indemnify us for any loss or damage we suffer as a result of your breach of this warranty. 

 

Third party websites & advertising 

 

  • The Site may contain articles, information & advertising from third-party businesses, people & websites (“Third-Parties”). You consent to receiving this information as part of your use of the Site. 

 

  • We are not responsible for any information transmitted by Third Parties or liable for any reliance you make upon the information or statements conveyed by Third Parties (or in relation to your dealings with Third Parties), nor are we responsible for the accuracy of any advertisements. 

 

Limitation of liability & indemnity 

 

  • You agree that you use the Site at your own risk. 

 

  • You acknowledge that we are not responsible for the conduct or activities of any User and that we are not liable for such under any circumstances. 

 

  • You agree to indemnify us for any loss, damage, cost or expense that we may suffer or incur as a result of, or in connection with, your use of or conduct in connection with the Site, including any breach by you of these Terms & Conditions. 

 

In no circumstances will we be liable for any direct, indirect, incidental or consequential damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity, loss of anticipated savings or any other similar or analogous loss resulting from your access to, or use of, or inability to use the Site or any content, or in any way relating to an experience itself (or the provision or non-provision of an experience), whether based on warranty, contract, tort, negligence, in equity or any other legal theory, and whether or not we knew or should have known of the possibility of such damage to business interruption of any type, whether in tort, contract or otherwise. 

 

Privacy policy 

 

  • You acknowledge and accept the Privacy Policy and agree that you will not do anything that shall compromise compliance with the Privacy Policy nor do anything contrary to the Privacy Policy insofar as your use of the Site is concerned. 

 

  • We may amend the Privacy Policy from time-to-time without notice and at our absolute discretion, and by continuing to use the Site you accept such changes. Please review the Privacy Policy regularly to ensure you are up to date with its contents. 

 

Termination & cancellation 

 

  • Your use of the Site may be cancelled at any time, for any reason, by Being Human on a temporary or permanent basis by written notice. You must immediately cease using the Site should you receive a notice cancelling your license to use the Site. 

 

Notices 

 

 

  • We will notify you of a change of details from time-to-time by altering these Terms and Conditions. 

 

General 

 

  • Nothing in these Terms & Conditions shall be deemed to form a relationship between Being Human and you of joint venture, partnership, employment or other association in any way other than parties to these Terms & Conditions. 

 

  • Any provision of these Terms & Conditions, which is invalid or unenforceable in any jurisdiction, is, as to that jurisdiction, ineffective to the extent of the invalidity or unenforceability without affecting the remaining provisions of these Terms & Conditions or affecting the validity or enforceability of that provision in any other jurisdiction. The parties will negotiate in good faith to replace any such provision with a provision which is valid and enforceable and consistent with the intention of these Terms & Conditions, so far as is reasonably practicable. 

 

  • For the purposes of these Terms & Conditions, “Force Majeure” means any cause beyond our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, actions taken by the police, acts or regulations of national or local governments, or the inability for us to hold the Event as a result of any epidemic/pandemic. Subject to the Tickets and Entry COVID-19 clause above, we will not be liable to you for failure to perform any obligation under these Terms & Conditions to the extent that the failure is caused by Force Majeure, and you shall not be entitled to any refund of any purchased tickets or any other loss. 

 

  • A consent, notice or communication under these Terms & Conditions effective if it is sent as an electronic communication (having the meaning given to that term in Electronic Communications Act 2000 and the Electronic Signatures Regulations 2002) unless required to be physically delivered under law. 

 

  • These Terms & Conditions form part of an e-commerce transaction, and the parties agree that these Terms & Conditions shall be accepted electronically and the agreement to these Terms & Conditions is formed & validly entered into electronically. 

 

  • The termination of these Terms & Conditions does not affect the parties’ rights in respect of periods before the termination of these Terms & Conditions. 

 

  • These Terms & Conditions are made in accordance with the laws of England & Wales.
